Patent documents combine language, technology and legal knowledge together, in which case the translation of patent documents is one of the hardest realms in professional translations. we have already translated large quantity of patent documents and studied on the features and writing styles of patent documents in China. Patents in China are divided into Invention Patent, Utility Model Patent and Design Patent.
Invention Patent: new technical programmes as to the manufacturing, method and improvement of products, such as the manufacturing method, workmanship, material formulas, medicine formulas and so on.
Utility Model Patent: new technical programmes that are appropriate for practical utility as regards the shape, structure or both of the products, which are called “small inventions” in practice.
Design Patent: new designs, beautiful and fit for industrial applications, as regards the shape, image or both as well as the combination of color, shape and image of products. The “exterior” is emphasized here, which means appearance, such as packing chest, packing bag and packing box.
 

Although Chinese applicants can submit PCT applications in Chinese in accordance with the provisions of Patent Cooperation Treaty (PCT), it is recommended that applicants write application documents in English, for the following reasons: (1) PCT applications will finally enter their respective countries to apply in, but if the applications are submitted in Chinese, the exact meanings of the original texts will sometimes be hardly expressed by translation, which brings great trouble to later examination and rights defense at the national phase, especially, when the applications enter other non-English speaking countries, it will be harder to ensure quality if the applications are further translated according to the English versions of the original Chinese texts; and (2) PCT applications submitted in English will be published in English, take patent applications filed in US for example, the data on which the applications serve as interfering applications under 35USC 102(e) can be advanced by one year and a half, thereby greatly improving the application efficiency.
